General Terms and Conditions of KENKAWAI GmbH
§1 Applicability to Entrepreneurs and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity (§13 BGB).
§2 Conclusion of a Contract, Storage of the Contract Text
(1) The following regulations regarding the conclusion of a contract apply to orders placed via our online store at https://kenkawai.com.
(2) In the event of the conclusion of a contract, the contract is entered into with:

(3) The presentation of goods in our online store does not constitute a legally binding contract offer but is an invitation to the consumer to submit a binding offer to purchase goods. By placing an order for the desired goods, the consumer submits a binding offer to enter into a purchase contract.
(4) Upon receipt of an order in our online store, the following rules apply: The consumer makes a binding contractual offer by successfully completing the order procedure provided in our online store.
The order process includes the following steps:

Selecting the desired goods by clicking on the respective product.

Adding the product to the shopping cart by clicking the "ADD TO CART" button.

Proceeding to checkout by clicking on the shopping cart.

Reviewing/correcting the shopping cart and proceeding by clicking the "Checkout" button.

Entering billing address, shipping address, and payment method, and proceeding by clicking the "Review Order" button. Alternatively, selecting "Express Checkout" for immediate purchase and payment via PayPal or Google Pay.

Reviewing the order and completing the purchase by clicking the "Pay now" button.
The consumer can correct input errors before submitting the binding order by using the "Back" button in their internet browser or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately through an automatically generated email ("Order #xxxx confirmed"). This email serves as our acceptance of your offer.
(5) Storage of the contract text for orders placed via our online store: We will send you the order data via email. The General Terms and Conditions can be accessed anytime at http://www.kenkawai.com/policies/terms-of-service. Your order details are no longer accessible via the internet for security reasons.
§3 Prices, Shipping Costs, Payment, Due Date
(1) The prices listed include statutory VAT in EU countries and other price components. Additional shipping costs may apply. Taxes/Customs: For deliveries to Switzerland, Norway, UK, USA and any other Non-EU countries, VAT is at 0% ; however, import duties must be paid by the customer. Please note: All orders are shipped excluding tax and customs duties. Import fees are the buyer’s responsibility.
(2) The consumer can pay by credit card (MasterCard/Visa), Klarna, Maestro, American Express, UnionPay, Shop Pay, Apple Pay, Google Pay, or PayPal.
§4 Delivery
(1) Unless clearly stated otherwise in the product description, all items offered are ready for immediate dispatch. Delivery will occur within 3-21 business days at the latest. For prepayments, the delivery period begins on the day after the payment order is issued to the transferring bank. For all other payment methods, the delivery period begins on the day after the conclusion of the contract. If the end of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.
(2) The risk of accidental loss and accidental deterioration of the sold goods passes to the buyer only upon transfer of the goods.
(3) Taxes/Customs: All product prices displayed on the website include the applicable VAT. For deliveries to Switzerland, Norway, UK, USA and any other Non-EU countries, VAT is at 0% ; however, import duties must be paid by the customer. Please note: the calculation of these duties depends on the value of the goods and the delivery address. All orders are shipped excluding tax and customs duties. Import fees are the buyer’s responsibility.
§5 Retention of Ownership
We retain ownership of the goods until the purchase price is paid in full.
§6 Right of Withdrawal for Consumers
Consumers have a right of withdrawal under the following terms. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, have taken possession of the goods.

via a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day we receive notice of your withdrawal from this contract.
For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back in undamaged condition.
You must return or hand over the unused and undamaged goods to us without delay and in any event no later than fourteen days from the day you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days expires.
We are unable to offer free returns at this time. Customers are responsible for the shipping costs of returning unwanted items. Please note that shipping fees are non-refundable.
You are liable for any diminished value of the goods if this loss in value is due to handling that was not necessary to check the condition, properties, and functioning of the goods. Unfortunately, we cannot accept returns for items that have already been used.
End of Withdrawal Policy
§8 Warranty for Material Defects
(1) Minor variations in material, color, weight, dimensions, or design due to technical improvements or developments are permissible as long as the changes are reasonable for the customer.
(2) Partial deliveries are allowed unless they are unreasonable for the customer.
(3) In the case of a defective product (such as weaving defects, wrong products), the customer has the right to subsequent performance.
(4) Warranty claims apply to new and unused goods. No guarantees are provided.
(5) The warranty ensures that the product meets the specifications documented at the time of contract and listed in the manufacturer’s product description. Public statements or advertisements are not considered warranties.
(6) The defectiveness of a product is determined under §434 BGB.
(7) The seller may choose the method of subsequent performance.
(8) The seller bears all necessary costs for rectifying defects, limited to the purchase price of the defective goods.
§9 Contract Language
The contract language is exclusively German or English.
§10 Privacy Notice
(1) Personal data will be processed in accordance with GDPR. This includes names, addresses, emails, phone numbers, and payment details for fulfilling the contract. Further details are provided in our privacy policy.
§11 Final Provisions
(1) German law applies, excluding UN sales law and international private law.
(2) For disputes, the place of jurisdiction is the seller’s registered location.
(3) If a provision is invalid, the remaining provisions remain binding.
